Хотите основать бизнес в Гонконге и получить рабочую визу? Несколько лет назад меня пригласили хорошие ребята из WYND прочесть лекцию на тему виз в Гонконге, учитывая все обстоятельства, являются наиболее реально достижимыми для жизни, работы или основания бизнеса в Гонконге. Итак, если вы являетесь иностранным гражданином, которым хочет открыть бизнес в Гонконге, вам может быть интересно знать о требованиях к визе. Одним из вариантов, доступных вам, является обычная рабочая виза, если ваша компания уже «хорошо установлена».
Рабочая виза
Обычная рабочая виза предназначена для иностранных граждан, обладающих профессиональными навыками, знаниями и опытом, который не могут быть легко найдены в Гонконге. Для одобрения, вам необходимо соответствовать определенному набору критериев, оцениваемых Иммиграционным Департаментом. Одним из них является то, что ваша компания уже должна быть «хорошо установлена».
Что же означает на практике “хорошо установленная” компания?
Это означает, что ваша компания:
Торговля ведется не менее 12 месяцев.
Приносит прибыль.
Наличие местного персонала из Гонконга.
Имеет подходящее помещение для ведения бизнеса.
Имеет достаточно средств для ведения платежеспособной деятельности.
Кто может подать заявку?
Для того, чтобы считаться профессионалом с целью получения этой визы, Иммиграционный Департамент ищет заявителей, имеющих степень бакалавра и как минимум два года опыта работы после выпуска в руководящей или надзорной должности.
Если у вас нет степени бакалавра, но есть техническая квалификация, то у вас должно быть как минимум пять лет опыта работы по профессии.
Для тех, у кого только среднее школьное образование, Иммиграционный Департамент ожидает от вас как минимум десять лет опыта работы после средней школы в руководящей или надзорной должности.
Как получить визу?
Для того чтобы получить рабочую визу, если вы «открываете бизнес», вам нужно быть владельцем компании, зарегистрированной в Гонконге, и иметь как минимум 50% доли акций в хорошо установленной компании. Вам потребуется трудовой договор с вашим собственным предприятием и компенсацией, соответствующей рыночным ставкам.
Иммиграционный Департамент будет изучать историю компании, включая оборот, наличие местного персонала и бизнес-операции, чтобы убедиться в добросовестности спонсора.
Если вам удасться успешно получить рабочую визу, вам будет предоставлен разрешение на проживание в течении двух лет. Эта виза позволяет вам работать только для бизнеса, который спонсировал вас, выполняя определенную работу, указанную в вашем контракте.
Эти критерии могут быть скорректированы в зависимости от фактических обстоятельств заявки, но в целом, полностью новая компания не может рассчитывать на рабочую визу для одного из учредителей. Виза на бизнес-инвестиции как предпринимателю является правильным типом визы для новых компаний, которые по определению не являются «хорошо установленными», поэтому критерии для одобрения заключаются в демонстрации того, что новый бизнес может внести значительный вклад в экономику Гонконга.
Можно ли параллельно основать бизнес?
Если вы являетесь работником третьего лица и хотите открыть бизнес параллельно или заниматься фрилансом, вы можете подать заявку на разрешение у Иммиграционного Департамента. Вам необходимо иметь письменное согласие вашего работодателя на отсутствие возражений в отношении ваших побочных занятий.
